Regulatory offences law

Regulatory offences · Notice · Objection

A hearing form or regulatory penalty notice often immediately raises questions about the time limit, the evidence, penalty points and a driving ban. The law firm WITTENSTEIN reviews your specific case systematically and, after inspecting the case file, develops the appropriate course of action.

Have you received a regulatory penalty notice?

Note the date of service and keep the letter and envelope. An objection against a regulatory penalty notice must, as a general rule, be lodged within two weeks of service under § 67 OWiG. Whether and by when action must be taken in the individual case will be assessed on the basis of the complete documents.

How we can assist you in regulatory offence proceedings

Hearing and witness questionnaire

We review the capacity in which you have been contacted, what information is requested and whether a statement is advisable at this stage.

Regulatory penalty notice and objection

Service, the alleged offence, the regulatory fine, fees and legal consequences are assessed together with the case file and evidence.

Speeding, following distance and red-light offences

In traffic offence cases, we take into account the measurement method, the measured value, the tolerance, driver attribution and any available photographic or video recordings.

Penalty points and driving ban

In addition to the regulatory fine, register entries and a driving ban may be decisive – in particular where there is an occupational or family dependency on driving.

Mobile phone, alcohol and cannabis

We assess the specific allegation, the authority's findings and any additional consequences under driving licence law separately from one another.

Other regulatory offences

Regulatory penalty proceedings outside road traffic are also examined on the basis of the notice, the competent authority and the relevant procedural situation.

This is how we proceed

  1. Safeguard the time limit and procedural status
The date of service, the authority, the file reference and any submissions already made are recorded first.
  2. Organise documents and evidence
The decision notice, the hearing, the measurement photograph and any other available documents are assigned to the specific matter.
  3. Inspection of the case file and legal review
On the basis of the available case file, the presentation of evidence, procedural issues and possible consequences are examined.
  4. Agree the approach with you
You will receive a clear assessment of the options, risks and next steps – without any promise of success and without any premature statement.

Which documents are helpful?

  • Hearing form, witness questionnaire or regulatory penalty notice in full
  • Service envelope and date of actual receipt
  • Measurement photograph, evidence photograph or other records, where available
  • Correspondence already sent and acknowledgements of receipt
  • Information on penalty points, probationary period or occupational reliance on driving, where relevant

Frequently asked questions about regulatory offences law

Do I have to respond to the hearing form immediately?

Which details are required or advisable depends on your role and the specific letter. A substantive statement should not be made without first reviewing the procedural situation.

Can a regulatory penalty notice also result in penalty points or a driving ban?

Depending on the allegation, further consequences may arise in addition to the fine and costs. The regulatory penalty notice and the underlying classification must therefore be examined in full.

What happens after an objection is lodged?

The administrative authority re-examines the matter. If it upholds the notice, the case may be brought before the competent court through the public prosecutor's office (§ 69 OWiG).

Make a targeted enquiry about a regulatory offence case

Based on your selection, your enquiry will be suggested to the appropriate specialist module. The law firm will review and confirm the allocation.

The enquiry does not yet establish a client relationship. Deadlines are only monitored after the mandate has been expressly accepted.
